An HMO and a health insurer are not the same. An HMO arranges agreed health services for members who pay a fixed fee in advance; an insurer pays the benefits written in a policy. Each holds a different IC licence, so a company with an HMO licence cannot sell you life insurance, and the reverse.

  • Insurer licences run three years. A Certificate of Authority ends on Dec 31 three years after it is issued and is renewed while the company keeps complying (Insurance Code sec. 193). HMO and pre-need licences are renewed by the IC under their own rules; pre-need licences are issued per licensing year.
  • VUL needs extra approval. A life insurer needs separate approval to sell variable life, and only an agent with a variable contract licence may sell it (sec. 238, 316).
  • Servicing companies sell nothing new. They only collect premiums, pay loans and surrender values, and reinstate policies already issued (sec. 286). The one professional reinsurer insures other insurers and does not sell to the public.

How to check a company

  1. Get the exact company name. It is on the policy, the plan contract or the official receipt. A brand such as Intellicare or iCare can belong to a company with a different legal name; the search above takes both.
  2. Match the Certificate of Authority number the company or agent gives you with the number on the company page here.
  3. Check the agent too. An agent needs an IC licence tied to the company they sell for. Search them on the agent check.

Claims and complaints

  1. File the claim or complaint with the company first, in writing, with the policy or plan number, what happened and what you want. Keep proof of the date. Each company page links the company's own claims page and hotline where it publishes them.
  2. No answer, or a refusal? Go to the Insurance Commission. It takes requests for assistance through its public assistance forms, by email to publicassistance@insurance.gov.ph or by phone on (02) 8523-8461 local 103 or 127.
  3. Report anyone selling without a licence to the IC Regulation, Enforcement and Prosecution Division, repd@insurance.gov.ph.

What the law then gives you depends on the licence:

  • If a claim is refused: you can file it with the IC instead of a court when it is ₱5,000,000 or less per claim (the limit since the 2013 amendment of the Insurance Code), not counting interest, costs and lawyer's fees. Either side can appeal to the Court of Appeals within 30 days.Insurance Code sec. 439
  • If an insurer becomes insolvent: the IC's Security Fund pays allowed claims that remain unpaid, up to ₱20,000 per claim under the Insurance Code as amended in 2013, and only for insurers authorized to do business in the Philippines.Insurance Code sec. 378
  • If a claim is refused: the IC regulates HMOs and sets the rules for adjudicating HMO claims, so the complaint goes to the IC.EO 192 sec. 4(a)
  • If an HMO fails: the IC can order measures to protect plan holders, including appointing a conservator, receiver or liquidator.EO 192 sec. 4(e), 4(i)
