The live-childbirth period is the same for normal and caesarean delivery. Marital status does not remove eligibility under the law. The leave is continuous, and at least 60 days must be postnatal.
Ask payroll to separate the SSS benefit and salary differential
For SSS maternity cash benefits, the law specifies at least three monthly contributions in the twelve months immediately before the semester of the contingency. Do not count only the three months before your due date.
For covered private-sector employees, the employer generally pays the difference between the SSS benefit and the required full pay. Statutory employer exemptions are subject to the applicable requirements. Ask payroll for the SSS amount, salary-differential calculation and the basis for any claimed exemption.
Build a leave plan around dates and documents
Keep the approved plan and update HR when the actual delivery date changes it. A calendar estimate made before childbirth may need to be corrected afterwards.
- Notify HR of the pregnancy and expected delivery date through the required process.
- Check the contribution record used for SSS qualification.
- Ask which notification, application and medical documents the employer needs.
- Confirm the planned start date, expected return date and payment schedule.
- If seeking solo-parent benefits or an extension, ask which additional documentation and notice apply.

Please show the maternity-pay computation in separate lines for the SSS benefit, employer salary differential and any applicable adjustments. Please also identify the contribution period used for eligibility and confirm the scheduled payment dates.
This request helps you see why a quoted SSS benefit differs from a full-pay estimate. A calculator that asks only for monthly salary cannot verify the contribution history or employer exemption.
Can the father use part of the maternity leave?
The mother may allocate up to seven days to the child's father, whether married to her or not. The law also provides for a qualifying alternate caregiver in specified circumstances. This allocation is separate from paternity leave under RA 8187.
Discuss the allocation with both employers before finalizing the leave calendar. Record the days allocated so the same days are not counted twice.
