Selling, buying or inheriting a property and the title still needs to move

We handle the paperwork that moves a title: the BIR returns for capital gains tax and documentary stamp tax, the eCAR, the local transfer tax, and registration of the new title and tax declaration. You get a reply within 48 hours of your enquiry with a quote or the questions we need to give one.

Is this you?

  • The deed of sale is signed, and now the BIR, the city hall and the Registry of Deeds all need something from you.
  • You've run the numbers on our calculator and want someone to take the filing and the queues from here.
  • A parent has passed away, the title is still in their name, and the family wants it settled.

What moving a title involves

The steps marked We handle this are the work you hand to us.

  1. Tell us about the property

    You

Send a short enquiry: sale, donation or inheritance, where the property is, and whether the deed is already signed. No TIN or documents yet.

  2. We reply with a quote or a few questions

    We handle this

Within 48 hours you get a quote, or the questions we need answered to give one. The quote lists the documents we'll ask for and the government taxes and fees, which are paid at cost.

  3. BIR returns and taxes

    We handle this

For a sale, the 6% capital gains tax and the documentary stamp tax are filed with the BIR office where the property is. For an inheritance, it's the estate tax return. We prepare the returns for your approval.

RA 8424 (NIRC) Sec. 24(D) (LawPhil)

  4. The BIR issues the eCAR

    Government office

Once the taxes are paid and the documents are complete, the BIR certifies the transfer. The Registry of Deeds won't register the new title without it.

RA 8424 (NIRC) Sec. 58(E) (LawPhil)

  5. Local transfer tax at the treasurer's office

    We handle this

The province or city charges a transfer tax, and the Registry of Deeds asks for proof it was paid before registering the deed.

RA 7160 (Local Government Code) Sec. 135 (LawPhil)

  6. New title and tax declaration

    Together

The Registry of Deeds issues the title in the new owner's name, and the assessor's office issues the new tax declaration so future amilyar bills go to the right person.

Questions

How much does it cost?

We quote each transfer instead of publishing one price. What affects the quote: sale, donation or inheritance, how many properties and titles, where the property is, and how many offices are involved. The taxes themselves are separate and paid at cost. Our capital gains tax, documentary stamp tax and transfer tax calculators give you a close estimate before you enquire.

What taxes are paid on a sale?

For an individual selling a property held as a capital asset: 6% capital gains tax on the higher of the selling price or fair market value, documentary stamp tax of ₱15 for each ₱1,000 (about 1.5%) on the same base, and the local transfer tax. Who pays which is up to the buyer and seller, so check what your deed says.

How much is the local transfer tax?

Provinces can charge up to 50% of 1% (0.5%) of the selling price or fair market value, whichever is higher. Cities can set rates up to 50% above that, so a city rate can reach 0.75%. It's due within 60 days of the deed, or of the death for an inheritance.

Can I do the transfer myself?

Yes. Many sellers and buyers do, and our guide to the taxes when buying property walks through each office. Help makes sense when you can't spare the days in queues, the property is in another province, or the title is still in a late parent's name.

The owner on the title has passed away. Can you still help?

Yes. The estate tax return is filed with the BIR, within one year of the death, before the property can go to the heirs. The heirs need a settlement document drafted by a lawyer first. We take it from the BIR onwards.

Who does the work?

Our team or one partner firm we work with that handles property transfers. Our first reply tells you who, and nothing is filed without your go-signal.
