Check whether the statutory SIL rule applies

The rule has exclusions, including employees already receiving at least five days of paid vacation leave, qualifying managerial employees and field personnel, and establishments regularly employing fewer than ten employees. Check the actual coverage rule before assuming that a five-day balance must be added on top of existing vacation leave.

One year of service means service within 12 months, whether continuous or broken, counted from your start date. Authorized absences, unworked weekly rest days and paid regular holidays count toward it. Ask HR which service period it used for your eligibility.

A statement such as "all unused leave expires" needs to be checked against the kind of leave involved. Equally, a contractual leave balance does not become cash-convertible just because statutory SIL is.

Example: unused SIL cash equivalent

Assume three unused convertible days and a confirmed ₱900 daily rate

The assumed unused balance is three days after eligible leave already taken has been deducted.

3 × ₱900 = ₱2,700

DOLE bases the cash conversion on the salary rate at the date of conversion, and unused SIL can be converted on a pro rata basis. A payslip monthly salary does not establish the daily rate without the applicable payroll basis. If you are leaving during the year, ask how HR determined the earned and unused amount up to separation.

How to ask for a leave reconciliation

Request the opening balance, current-year entitlement, dates used, cash conversions and closing balance. Put your own leave approvals beside that record and mark the dates that differ.

If your employer supplies a single combined paid-time-off balance, ask which part satisfies statutory SIL and which part is an additional company benefit. The distinction matters when checking whether leave can expire, carry forward or convert to cash.

Check the balance when you leave

Bring the confirmed convertible amount into the final-pay statement as its own line. Retain the leave ledger and the policy used for conversion so you can reproduce the calculation later.

For a dispute, identify whether it concerns eligibility, the number of days or the daily rate. Ask DOLE about the applicable rule with that specific issue and the records to hand.
