Check the applicable retirement arrangement first
In the absence of an applicable retirement plan or agreement, RA 7641 provides for retirement from age 60, compulsory retirement at 65, and at least five years of service in the establishment.
The statute excludes retail, service and agricultural establishments or operations employing no more than ten workers. Some occupations have special retirement rules. Request the company plan and confirm which regime applies before using the formula.
Why the multiplier is commonly 22.5 days
The statutory half-month definition includes 15 days, a 13th-month component equivalent to 2.5 days, and the five-day leave component used in the standard minimum computation. The Supreme Court has addressed the 22.5-day multiplier in Grace Christian High School v. Lavandera.
For the usual statutory computation, multiply the applicable daily rate by 22.5 and by credited years. A service fraction of at least six months counts as a whole year.
Example: twelve years and eight months
Assume coverage and a confirmed ₱1,000 daily rate
Twelve years and eight months gives thirteen credited years in this example. The standard statutory computation uses 22.5 days per credited year.
₱1,000 × 22.5 × 13 = ₱292,500
A calculation using only 15 days would produce ₱195,000 with the same inputs, a difference of ₱97,500. Confirm your eligibility and daily rate before applying this calculation.
Compare the company plan with the statutory minimum
Ask for the retirement plan, its eligibility conditions, compensation basis and treatment of service fractions. Benefits under the applicable agreement must be checked against the legal minimum. Do not assume a plan described as "one month per year" uses the same pay basis as another plan.
Keep SSS retirement benefits and the employer's retirement benefit separate in your worksheet. Obtain the statement for each benefit before adding them into your retirement budget.
Documents to request before retiring
Ask payroll or a qualified adviser to confirm the tax treatment of the actual benefit. A labor-law entitlement does not, on its own, prove that every retirement payment is tax-exempt.
- Confirmed employment dates and credited years of service.
- The retirement plan or written explanation of the statutory basis.
- The daily or monthly compensation basis and all included items.
- An itemized computation with any tax treatment explained separately.
- The expected payment date and other outstanding final-pay components.
